1. Introduction

1.1. These Terms & Conditions (“Terms”) govern your use of our services provided by Performance Goal CIC (registered as a private company limited by guarantee, company number SC844636.
1.2. As a Community Interest Company, our primary purpose is to benefit the community while operating on commercial terms. These Terms apply to all revenue-generating activities, sponsorship arrangements, and funding received.

  1. Scope of Services

2.1. We provide business training, consultancy, community programmes, we also are involved in the personal and collective development of individuals and teams, including directors, managers and coaches and may act as an intermediary for sponsorship or funding initiatives.
2.2. Separate service-specific agreements (e.g., sponsorship agreement) will accompany these Terms where applicable.

  1. Payment Terms

3.1. Accepted Payment Methods
• Bank Transfer (our preference for one-off payments)
• Direct Debit (for recurring payments)
• Cash payments (up to £100)

3.2. Payment Timing and Currency
• All invoices are payable in GBP within 30 days of issue unless otherwise stated.
• Where Direct Debit is used, payment will follow the Bacs/SEPA mandate provided by you.

3.3. Late and Failed Payments
• Late payments incur interest at 4% per annum above the Bank of England base rate, calculated daily.
• Failed Direct Debits may incur additional admin fees.

3.4. Payment Allocation
Payments will first be applied to interest, then outstanding principal.

  1. Sponsorship & Funding

4.1. Sponsorship
• Sponsorship starts upon receipt of the agreed amount and continues until completion of the agreed activity.
• Terms will specify deliverables, branding rights, and termination clauses.

4.2. Funding & Grants
• We commit to applying donations/funds as stated in materials. Any surplus will be used per operational costs.
• Use of donor-designated funds will be respected; otherwise, surplus funds will be redirected to our community objectives.

  1. Refunds & Cancellations

5.1. One-off events may be refunded in full up to 14 days before the event, less any unrecoverable costs.
5.2. No refunds within 14 days unless we cancel the event.
5.3. Direct Debit payers can cancel via bank instruction; we may seek outstanding sums through the small claims court.

5.4. Player Development Initiatives: Once a player development program has commenced, the program may be cancelled by either party upon providing thirty (30) days written notice. No refunds shall be issued for any fees paid in respect of services or development activities already rendered or delivered prior to the effective date of cancellation.

  1. Liability & Insurance

6.1. We shall perform services with reasonable care.
6.2. We are not liable for indirect, incidental, or consequential losses.
6.3. Our liability is capped at the total fees paid for the service.

  1. Data Protection & Privacy

7.1. Personal data will be processed per UK GDPR for the provision of services and fulfilment of obligations.
7.2. We will not share personal data without consent unless required by law.

  1. Asset Lock & Community Benefit

8.1. As a CIC, we operate under the statutory asset lock. Profits are reinvested for community purposes, unless mandated otherwise within regulatory limits.
8.2. On dissolution, remaining assets are transferred to another asset-locked body.

  1. Termination

9.1. Either party can terminate by 30 days written notice.
9.2. On termination, any outstanding fees become immediately due; refunds will be pro-rated or at our discretion.

  1. Dispute Resolution & Governing Law

10.1. We aim to resolve disputes amicably.
10.2. If unresolved within 30 days, disputes fall under Scottish law and the exclusive jurisdiction of UK courts.

  1. Amendment of Terms

11.1. We reserve the right to amend these Terms.
11.2. Notice of changes will be provided 14 days in advance and you may terminate if disagreeing.
